One of the most common questions we get — especially from clients with urgent cases — is: can a process server serve legal documents on a Sunday in Florida? The answer is yes, with one important exception.

Florida Law on Sunday Service

Under Florida Statute §48.20, service of process is generally permitted on any day of the week including Sunday — except for certain criminal process documents. For the vast majority of civil cases — summons, subpoenas, divorce papers, eviction notices, injunctions, and restraining orders — Sunday service is completely valid under Florida law.

What Cannot Be Served on Sunday in Florida?

Florida Statute §48.20 carves out one exception — criminal process cannot be served on Sunday unless authorized by a judge. This applies to criminal arrest warrants and certain criminal summons. For virtually all civil matters, Sunday service is permitted.

Is Saturday Service Also Permitted in Florida?

Yes — Saturday service is fully permitted for all civil process in Florida with no restrictions. Our servers regularly make weekend attempts as part of the standard service package.

What About Holidays?

Florida law does not prohibit service of civil process on state or federal holidays. A process server can legally serve documents on Thanksgiving, Christmas, or any other holiday if needed. For emergency situations, holiday service is available with our same-day rush option.

At Spotlight Serve, weekend attempts are always included in our standard $95 flat rate. We don’t charge extra for Saturday or Sunday attempts. Our servers work seven days a week so your case doesn’t sit idle over the weekend.
