Florida Law on Workplace Service

Under Chapter 48 of the Florida Statutes, service of process can be made at a person’s usual place of abode or their place of business. There is no Florida law that prohibits serving someone at their workplace, and in many cases it’s one of the most effective ways to complete service — especially if the subject is avoiding service at home.

  5. Document the time, location, and details in the affidavit of service

What If an Employer Refuses to Let the Server In?

If a business has restricted access — such as a secured office building or a manufacturing facility — a process server cannot force entry. In these cases the server will:

  • Wait for the subject at the building entrance before or after work hours
  • Attempt service at the subject’s home address
  • Coordinate with you to identify the best time when the subject is accessible

Can an Employer Intervene to Block Service?

No. An employer cannot legally instruct a process server to leave their property simply to protect an employee from being served. While a business owner can ask a server to leave private property, deliberately obstructing service of process can have legal consequences.
