How Long Does Service of Process Take in Florida?
If you’ve ever hired a process server in Florida — or are about to — one of the first questions you probably have is: how long is this going to take? The answer depends on several factors, including the type of service, the county, and whether the subject is cooperative or evasive.
At Spotlight Serve, we handle service of process throughout Hillsborough County, Pinellas County, Pasco County, and Polk County — including the Thirteenth, Sixth, and Tenth Judicial Circuits. Here’s exactly what you can expect.
Standard Service Timelines in Florida
| Service Type | Timeline | Price |
|---|---|---|
| Routine Service | 3–5 business days | $95 flat rate |
| Rush Service | Within 48 hours (in-state) | +$60 |
| Same Day / Emergency | Within 24 hours (in-state) | +$150 |
| Out of State | 5–10 business days | $135–$250 |
What Is Routine Service?
Routine service is the standard option and what we recommend for most cases. Our $95 flat rate includes four attempts across different time windows — one before noon, one after 5PM, one on a weekend, and additional attempts at the server’s discretion.
💡 Our 4-attempt guarantee means we don’t stop after one try. Most serves are completed within 3–5 business days when the subject is accessible.
What Is Rush Service in Florida?
Rush service means a process server will make an attempt within 48 hours of receiving your paperwork. This is ideal when you have a filing deadline approaching or a hearing scheduled soon. Rush service in Florida adds $60 to the base rate.
What Is Same Day / Emergency Service?
Emergency service is exactly what it sounds like — we make an attempt as soon as possible, within 24 hours of receiving your documents. This is the fastest option available and adds $150 to the base rate. It’s typically used when a restraining order, TRO, or emergency hearing requires immediate service.
What Slows Down Service of Process?
Several factors can extend the timeline:
- Evasive subjects — people who know they’re being served and actively avoid it
- Incorrect addresses — outdated addresses on court documents
- Gated communities — restricted access can delay attempts
- Business entities — serving a corporation requires finding the registered agent
- Out-of-state subjects — requires coordination with our partner network
What Happens If Service Can’t Be Completed?
Under Florida law (Chapter 48, Florida Statutes), if a subject cannot be personally served, there are alternative methods available including:
- Substitute service — serving another adult resident at the same address
- Service on a registered agent — for business entities
- Posting / constructive service — for evictions and certain civil matters
- Service by publication — when a subject cannot be located after diligent search
Service of Process Timelines by County
We serve all four major Tampa Bay area counties. Here’s what to expect by jurisdiction:
Hillsborough County (13th Judicial Circuit)
Tampa and surrounding areas including Brandon, Riverview, Apollo Beach, Plant City, and Gibsonton. Our servers know Hillsborough County thoroughly — neighborhoods, gated communities, and courthouse procedures.
Pinellas County (6th Judicial Circuit)
Clearwater, St. Petersburg, Largo, Dunedin, and surrounding areas. Pinellas is densely populated which can sometimes mean more efficient service — we know the area well.
Pasco County (6th Judicial Circuit)
New Port Richey, Wesley Chapel, Zephyrhills, Dade City, and Land O Lakes. Pasco County has been growing rapidly — we have reliable coverage throughout the county.
Polk County (10th Judicial Circuit)
Lakeland, Bartow, Winter Haven, Haines City, and surrounding areas. We coordinate Polk County service through our trusted partner network ensuring timely attempts.
Tips to Speed Up Service of Process
- Provide the most current address you have for the subject
- Include work address if available
- Note any access restrictions (gate codes, apartment numbers)
- Mention known schedules (e.g. “subject walks dog at 7:30AM”)
- Consider skip tracing ($25) if you’re unsure of the current address
